leave, to ease the transition to civilian life. The five (5) days of excused absence is applicable each time the employee returns from deployment. Employees who have returned to work and have not taken the five (5) days of excused absence for a second or subsequent deployment may be granted such time off, as long as the time is mutually agreeable to the employee and his/her supervisor.
An employee who requests military leave for inactive duty training (usually 2, 4, or 6 hours in length) is charged only for the amount of military leave necessary to cover the period of military training and necessary travel.
Hours in the regularly scheduled workday that are not chargeable to military leave must be worked or charged to another category of leave; e.g., annual leave, LWOP, compensatory time, as appropriate. You do not have a "right of refusal" for military leave and cannot take any adverse action against the service member, or threaten to take adverse action, for leaving for service.
Similarly, you may be prohibited from taking adverse action against the service member, or threatening to take adverse action, if the service member does not provide notice. However, if your employee's absence would cause a significant burden, you may contact the commander of your employee's military unit to ask if the duty could be rescheduled or performed by another service member.
Excused Absence Upon Return From Active Military Service
If this request is not fulfilled, you must still provide unpaid leave so your employee can perform his or her military duty, and you cannot take any adverse action against the employee. D. 5 U.S.C. 6323(d) authorizes 352 hours (44 days) of military leave.
This type of military leave is applicable for Reserve and National Guard Technicians only. The active duty orders for this type of military leave must cite 10 U.S.C. 12315, 12301(b), or 12301(d) for an employee to be eligible for this entitlement.

An employee who is entitled to 176 hours (22 workdays) of military leave under 5 U.S.C. 6323(b) may be granted accrued annual leave or accumulated compensatory time prior to exhausting the military leave available under 5 U.S.C.
6323(b). However, unused military leave under 5 U.S.C. 6323(a) may only be granted once all military leave under 5 U.S.C. 6323(b) is exhausted (49 Comp. Gen. 233). Crediting the Leave. This type of military leave is credited on a CY basis and unused leave may not be "carried over" to a new year.

Maximum Accruals. Full-time employees may accrue 120 hours (15 days) of military leave under this authority. Unused military leave may be carried over into a succeeding FY year providing for a maximum balance of up to 240 hours (or 30 days) during a FY.
Pay Status During Period Of Military Leave
If the carried over military leave is unused by the end of the current FY, it is forfeited and may not be restored for use. An eligible employee must be granted, upon request, military leave to which he or she is entitled for performance of active duty or active duty for training. With the exception of military leave granted under 5 U.S.C.

6323(b) and 5 U.S.C. 6323 (c), accrued annual leave, accumulated compensatory time, or LWOP shall not be granted for such active duty until the employee has used all available military leave. When an employee transfers from one Federal agency to another, any unused military leave authorized under 5 U.S.C 6323(a) is credited to the employee for use during the remainder of the FY and for carryover into the succeeding FY, as appropriate.
If an employee is separated and not reemployed during the FY in which separated, any unused military leave under 5 U.S.C. 6323(a) may be credited to the employee if reemployed in the Federal service during the FY which immediately follows the FY in which he/she separated.
Lump Sum Payments
If the employee does not return to duty during the same or succeeding FY in which separated, any unused military leave under 5 U.S.C. 6323(a) is forfeited. An employee ordered to military duty while on extended LWOP may not have the LWOP converted to military leave.
However, an employee's eligibility for military leave is not affected if he or she is granted LWOP for a period immediately before or after military duty to attend to personal matters (37 Comp. Charging Military Leave. Although this type of military leave is generally referenced in 8-hour workdays, it is measured in increments of one hour. The minimum charge is one hour. An employee is charged military leave only for hours that the employee would have worked and received pay.
Requesting Adjustments To Military Orders
Applicable Uses. This type of military leave may be used for active duty, active and inactive duty training, or engaging in field or coastal defense training at encampments, maneuvers, outdoor target practice, or other exercises. Inactive duty training is authorized training performed by members of a Reserve component not on active duty and performed in connection with the prescribed activities of the Reserve component.
It consists of regularly scheduled unit training periods, additional training periods, and equivalent training. (For additional information, see Department of Defense Instruction Number 1215.6, March 14, 1997.) Contingency Operation is a military operation that is: (1) designated by the Secretary of Defense as an operation in which members of the armed forces are or may become involved in military actions, operations, or hostilities against an enemy of the United States or against
an opposing military force; or (2) results in the call or order to, or retention on, active duty of members of the uniformed services under section 688, 12301(a), 12302, 12304, 12305, or 12406 of title 10, United States Code (U.S.C.
), chapter 15 of title 10, U.S.C., or any other provision of law during a war or during a national emergency as declared by the President or Congress. An employee is entitled to any premium pay normally received for his or her regularly scheduled shift or tour of duty (i.e., overtime, night differential, standby, etc).
Conversion Of Annual Leave Or Lwop To Military Leave
An agency or work unit may not deny an employee any premium pay to which he or she is normally entitled by re-scheduling the employee to a shift that excludes premium pay because the employee has been ordered to military duty.
An employee may elect to receive a lump-sum payment for any unused annual leave when he or she separates from active duty in the armed forces. Generally, a lump-sum payment will equal the pay the employee would have received had he or she remained employed until the expiration of the period covered by the annual leave.
